Legal basement apartment in Brampton

A legal basement apartment in Brampton costs $75,000 to $110,000 or more to build with Desire Basements and takes about three months. Unlike Toronto, Brampton runs a mandatory registry: the suite is applied for as a Two-Unit Dwelling, pays a $200 registration fee plus a $1,186.24 permit fee, passes the City's mandatory inspections, and receives a registration certificate when occupancy is granted. Only then is it legal to rent.

The registration path, in Brampton's order

    Confirm the lot can take a second unit

    Brampton's zoning summary for a two-unit dwelling sets five conditions: one second unit per house; the unit smaller than the principal dwelling; no extra parking, but the lot keeps the minimum spaces it already needs; an entrance in the side or rear yard with a 1.2 m unobstructed path to the front, entirely on your property, or an entrance through the garage or a shared vestibule; and no units on Open Space, Floodplain or Downtown Floodplain Regulation lands. Properties inside Credit Valley Conservation or TRCA regulated areas need the conservation authority's approval first, or the permit stops.

    Design and 3D

    A free in-home visit, a ceiling-height check against the 1.95 m Part 11 minimum, and a free 3D design of the suite. Permit drawings are prepared and stamped by a licensed structural engineer while the design is finalized.

    File the Two-Unit application

    Through the Brampton Building and Business Portal: the Application for Registration and Change of Use Building Permit, Two-Unit Dwelling; the $200 registration fee and the $1,186.24 permit fee; a legible legal survey with the surveyor's signature (the City does not keep surveys for every property); and complete drawings.

    Build to Part 11

    Pass the mandatory inspections

    Brampton publishes a list of mandatory inspections for two-unit dwellings and charges an Inspection Recall Fee once an inspection fails twice. We book each one and are on site for it. The electrical work is inspected by the Electrical Safety Authority; the City now notifies the ESA about new units itself, so you no longer email the ESA certificate to the zoning office.

    Registration certificate

    Issued when occupancy is granted on the permit. The address joins Brampton's public map of registered additional residential units, which is what a careful tenant, a mortgage lender and your insurer will look for.

What a Brampton suite costs

Every basement is priced from the same quote sheet, line by line: a 1,000 sq ft basement with a three-piece bathroom comes to about $67,800 before HST, and the price per square foot falls as the basement grows because the permit, bin, breakers, stairs and bathroom cost the same at any size. A suite is the same build with the Code items added as lines you can read: kitchen rough-ins at $1,800, the fire separation, the alarms, the egress window or entrance. That is how a purpose-built Brampton suite lands at $75,000 to $110,000 or more.

Brampton's newer subdivisions usually clear the 1.95 m minimum, so the $60,000 to $120,000 underpinning bill that decides many Toronto projects is less common here. Where a ceiling falls short, we say so at the first visit with the number attached.

GTA legal suites rent for $1,700 to $2,400 a month in 2026. At $2,000 a month a $95,000 suite pays back its gross cost in roughly four years, before property tax, insurance, utilities and income tax. Since May 2023 Brampton allows a principal dwelling plus two more units, as a second and third unit inside the house or a second unit plus a garden suite, and a registered second unit can be followed by a third on its own application. Does a basement apartment have to be registered in Brampton?

Yes. The City states that second units, third units and garden suites must be registered with the City of Brampton to be legal. Registration runs through the Two-Unit Dwelling building permit, mandatory inspections and a registration certificate issued when occupancy is granted.

Do I need extra parking for a second unit in Brampton?

No. Brampton's zoning summary says no additional parking is required to create a second unit, but the lot must keep the minimum parking spaces the Zoning By-law already requires for the house.

Where can the entrance to a Brampton basement apartment be?

In the side or rear yard, as long as there is a 1.2 m unobstructed path to the principal entrance located entirely on your property, or inside the garage, or through a common vestibule in the house. A side-yard landing is allowed if it is under 0.6 m high and no more than 0.9 m by 0.9 m.
